These Regulations apply to purchases made via the online store "Kisskin.pl"
Parties and Regulations
The website at www.kisskin.pl is run by Sylwia Włodarczyk, running a business under the name "Sylwia Włodarczyk Design" with its registered office in Warsaw, 03-984, at ul. Jugosłowiańska 15a / 25, NIP 113-245-57- 49 REGON 382437873. Economic activity is registered in the Central Register and Information on Economic Activity (CEIDG), kept by the Minister competent for economy.
Goods purchased by the Customer via the "Kisskin.pl" e-Shop are sold by Sylwia Włodarczyk, acting as a Seller, in her own name.
Making purchases of products in the e-Store "Kisskin.pl" requires acceptance of the privacy policy. Information on the principles of collecting and using information about users of the e-Store "Kisskin.pl" Customers will find in our privacy policy.
The purchases of Goods made by the Customer via the "Kisskin.pl" e-Store are subject to the following terms and conditions of sale.
§1. DEFINITIONS
1. Seller - Sylwia Włodarczyk, referred to in the introduction of the Regulations;
2. Customer - an entity that performs an Order / Purchase as part of the e-Store "Kisskin.pl";
3. e-Shop "Kisskin.pl" - Website available at: http://www.kisskin.pl/ through which the customer can in particular place orders;
4. Goods - products presented / sold in the Online Store (e-Shop "Kisskin.pl");
5. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code concluded with the use of the Online Store;
6. Civil Code - the Act of 23 April 1964. (Journal of Laws No. 16, item 93, as amended);
7. Consumer Rights Act - Act of 30 May 2014. (Journal of 2014, item 827, as amended);
8. The Act on the provision of electronic services - the Act of 18 July 2002. (Journal of Laws No. 144, item 1204, as amended);
9. Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods;
10. Business days - days of the week from Monday to Friday, excluding statutory holidays.
§2. GENERAL PROVISIONS
These Regulations apply to all Orders and Purchases of Goods made through www.kisskin.pl
These Regulations have been drawn up on the basis of legal provisions in force in the territory of the Republic of Poland. Regulations and legal provisions in an exclusive and exhaustive manner regulate the use of the e-Store "Kisskin.pl", available at http://www.kisskin.pl, providing services consisting in the sale of goods constituting jewelry from precious metals and stones precious.
The Regulations shall specify in particular:
a) the type and scope of services provided electronically;
b) terms and conditions for submitting orders via e-Store "Kisskin.pl" by e-mail;
c) the principles of concluding and terminating Sales Agreements with the use of services provided as part of the e-Store "Kisskin.pl";
d) the complaint procedure.
4. The images of jewelery presented on the www.kisskin.pl website are informative. Please be advised that the appearance of the Goods is influenced by the size and setting of the monitor parameters.
5. Submission of the purchase statement in electronic form means that all declarations of will, notices, information and other messages submitted in electronic form will be qualified as meeting all the requirements for communication in writing.
6. These Regulations may be subject to periodic changes, while the date of entry into force of the amendments will be indicated on the website www.kisskin.pl. The amended Regulations will apply to orders placed from the date of entry into force of the amendments.
§3. SUBMIT AN ORDER
1. To obtain the opportunity to purchase the Goods it is necessary to:
- acceptance of these Regulations and e-Sklep privacy policy, "Kisskin.pl"
- indication of the name, address, telephone number, e-mail address, payment details and other required information;
- indication of the current delivery address (Seller, does not deliver to mailboxes).
2. To place an order, log in and then fill in all fields of the order form (data in accordance with the actual state) and submit the form using the e-Shop "kisskin.pl".
3. The order can be placed 24 hours a day.
4. Every order of the Goods is treated as a separate purchase offer. The placed order will then be subject to the acceptance of the Seller, whereby the Seller has the right to:
- non-acceptance of the order with the simultaneous obligation to indicate the reasons for such a decision,
- limitation of the payment method,
- requesting a prepayment,
5. In the event that the number of Goods accepted by the Seller is less than the number of Goods ordered, informs the Customer about the above to the indicated e-mail address. The customer has the right to resign from the order. This right may be exercised by the Customer within 7 days from the date of receipt of information from the Seller.
6. The seller reserves the right to refuse the order.
7. A separate order is made for each Good.
§4. COMPLETION OF THE ORDER AND CONCLUSION OF THE AGREEMENT
Immediately after receiving the Order via the "Kisskin.pl" e-Store, an e-mail will be sent to the Customer, at the e-mail address provided, confirming the receipt of the Order and specifying the details of the ordered Goods (Order Receipt Confirmation). The above e-mail does not confirm the acceptance of the Order, but only confirmation of its receipt.
After receiving the Order and sending the Confirmation of Order Receipt, the Seller will check the availability of the ordered Goods. The contract between the Customer and the Seller will be concluded at the time of confirmation, in the form of an e-mail sent to the e-mail address indicated by the Customer, that the ordered Goods are available and will be delivered to the Customer after noticing the payment made by the Customer (Shipment Confirmation).
The Seller commences the execution of the Order simultaneously with the Confirmation of Order Receipt.
§5. PRICE, SHIPMENT AND PREPARATION OF SHIPMENT. FEES AND TAXES.
The price of the Goods is the price indicated on the individual page presenting the Product at the time of ordering.
The price of the product includes VAT, and other applicable taxes, but does not include shipping and preparation costs.
Fees for shipping, preparation for shipment and related VAT and other taxes, as well as the total price for the contract will be indicated on the form displayed before the Customer confirms the submission of the Order and in the Confirmation of the Order. The shipping fees depend on the place of delivery and the method of delivery chosen by the Customer during the order placement process.
Shipments are carried out via Polish mail.
Before the delivery receipt is confirmed, the customer is obliged to check whether the packaging has not been damaged in transport.
§ 6. PAYMENT
Payments can be made via one of the following methods, chosen during the ordering procedure: transfer to your account.

If there is no payment within 14 days from the date of the order, the transaction will be deemed obsolete and will be automatically canceled.
§ 7. DELIVERY
The Seller will complete the Order when the funds are credited to your account. The Seller shall not be liable for failing to meet the deadline due to reasons beyond his control, in particular in the event of force majeure, i.e. any circumstances beyond the Seller's control, including in particular war, terrorist acts, strikes, states of exception, non-functioning means of transport, interruptions in power or media supplies, earthquakes or other natural disasters. Each parcel will be issued with a receipt or VAT invoice (on request) covering the price of the Goods and the costs of shipment preparation, which will be sent together with the parcel or to the e-mail given in the form. Shipments are sent twice a week (Tuesday and Friday). In the case of free days from work, shipments will be sent immediately on the first business day.
§8. PRODUCT PROPERTY
Risks related to the delivered Goods are transferred from the Seller to the Customer upon delivery of the parcel (collection by the Customer).
§ 9. NOTIFICATION OF THE RIGHT TO WITHDRAW
1. Pursuant to Article 27 of the Act on consumer rights, the Customer is entitled to 14 (fourteen) -day period for exercising the right to withdraw from the Agreement for the sale of Goods purchased via the e-Store "Kisskin.pl" without indicating the reason for withdrawal. The withdrawal may be made in writing (including in the form of a letter or e-mail) or by returning the Goods purchased via the "Kisskin.pl" e-Store before the indicated 14-day deadline for withdrawal. The indicated 14-day period for withdrawal commences on the day of delivery of the Goods purchased via the "Kisskin.pl" e-Store.
2. In order to keep the indicated period of withdrawal, it is sufficient to send: a statement on withdrawal from the Agreement or return of the Goods before its expiry. The statement on withdrawal from the Agreement should be sent to the following address: ul. Jugosłowiańska 15a / 25 03-984 Warsaw. The statement must be accompanied by a receipt / invoice as proof of purchase.
3. Returns and exchange are not subject to individually customized products, which include: products with an engraving, hand-made rings, non-standard patterns and lengths of chains and necklaces.
4. The returned products can not bear traces of use, otherwise the goods may be sent back to the customer at his expense.
§10. LEGAL CONSEQUENCES OF EXERCISING THE RIGHT TO WITHDRAW
1. In the event of the effective exercise of the right to withdraw from the Agreement, all benefits of the parties and the remuneration received as a result of the performance of the Agreement shall be reimbursed. If the benefits received can not be returned (eg benefits resulting from the use) or can be returned only partially, the customer will be obliged to return the value of the non-returnable benefits.
2. The Customer shall be obliged only to pay remuneration for the decrease in the value of the Product, which is the result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Good. "Establishing the nature, characteristics and functioning of the Goods" means trying out and trying on the Goods in a manner that is possible and customarily accepted in traditional stores.
3.Goods sent by courier service should be returned via the same operator. The Customer is responsible for sending the Goods back.
4. The obligation to return the payment made will be made by the Seller within 14 (fourteen) days. The deadline for returning the Goods starts with running for the Customer from the date of the Customer's declaration of withdrawal from the Agreement or the dispatch of the Goods. For the Seller, the 14-day deadline starts running from the date of receipt of the statement on the resignation or delivery of the returned Goods.
5. The return of payment will be made using the same payment methods used by the Customer in the original transaction.
§11. WARRANTY AND LEGAL RIGHTS ARISING OUT OF LAW
1. Under Article 556 of the Civil Code, the Customer is entitled to statutory rights resulting from the warranty. The seller is liable under the warranty if the product sold has physical or legal defects.
2. The scope of the warranty is two years (the warranty covers defects that were found within two years from the date of delivery of the Goods to the Customer).
3. The customer should keep the order confirmation / invoice, or transfer it to the person for whom the product was purchased, as proof of purchase entitling him to use the warranty.
4. The obligation to return the payment made will be made by the Seller within 14 (fourteen) days. The deadline for returning the Goods starts with running for the Customer from the date of the Customer's declaration of withdrawal from the Agreement or the dispatch of the Goods. For the Seller, the 14-day deadline starts running from the date of receipt of the statement on the resignation or delivery of the returned Goods.
5. The return of payment will be made using the same payment methods used by the Customer in the original transaction.
§11. WARRANTY AND LEGAL RIGHTS ARISING OUT OF LAW
1. Under Article 556 of the Civil Code, the Customer is entitled to statutory rights resulting from the warranty. The seller is liable under the warranty if the product sold has physical or legal defects.
2. The scope of the warranty is two years (the warranty covers defects that were found within two years from the date of delivery of the Goods to the Customer).
3. The customer should keep the order confirmation / invoice, or transfer it to the person for whom the product was purchased, as proof of purchase entitling him to use the warranty.
4. They do not constitute a non-conformity of the Goods with the Agreement, including:
- obvious defects, visible on the day of purchase, which the Customer knew or reasonably assessed should know,
- mechanical damage (dents, abrasions, deformations) resulting from reasons beyond the control of the Seller. Due to the high delicacy of the products, the company reserves that warranty repair does not cover torn chains, because such damage can only arise as a result of improper use,
- discoloration and damage caused by improper use or maintenance,
- natural consumption of goods as a result of using it in accordance with the intended purpose (especially gold-plated, clad or satin jewelery).

§13. EXTRAORDINARY METHODS OF EXAMINING COMPLAINTS AND INVESTIGATING CLAIMS
1.Seller, within 14 days will recognize each complaint made by the customer and address it.
2.If the dispute can not be resolved, the parties to such dispute will be able to seek its settlement by proceeding before the Permanent Consumer Arbitration Court at Mazowieckie Provincial Inspector of Trade Inspection, ul. H. Sienkiewicza 3, 00-015 Warsaw
§14. APPLICABLE LAW
These Regulations, as well as purchases of Goods made via the "Kisskin.pl" e-Store are subject to and should be interpreted in accordance with Polish law.
